COVINGTON - A Northern Kentucky doctor was arrested after a patient agreed to wear a hidden camera to capture him sexually abusing her, according to state police.
The recording was made on Feb. 28 in the doctor's Ludlow office, at 120 Elm St. He was arrested by state troopers Tuesday at his Florence office.
Dr. Daryl R. Franks, 38, of Union pleaded not guilty Wednesday in Kenton District Court. He is charged with two counts of third-degree sexual abuse and one count of indecent exposure. Both charges are misdemeanors punishable by up to 90 days in jail.
A judge ordered Franks not to treat or diagnose female patients without the presence of another licensed doctor or nurse. Franks was released from jail Tuesday after paying $2,500 to secure a bond.
The Kentucky Board of Medical Licensure lists Franks as in good standing with no disciplinary actions against him in the last 10 years. Board records show he has been a licensed general practitioner in the state since 1998. He graduated from the University of Kentucky College of Medicine in 1994.
Franks didn't return phone messages left at his offices and home and his attorney declined to comment.
A woman told state police that on Jan. 13, during a monthly visit, Franks inappropriately touched her after she undressed, and exposed himself, according to a criminal complaint. She told police Franks refused to let her leave his office until she made another appointment.
Police had her wear a hidden camera during her next visit, according to court records. During that visit, police said, Franks again touched the patient inappropriately while she was partially undressed.
The hidden video camera recorded him uttering, "Shh," when the patient tried to get Franks to talk about the prior incident, according to the complaint.
There is a pretrial hearing in the case at 9 a.m. on April 12 in Kenton District Court.
